Question about Gift Certificate Terms and Conditions

While I am familiar with my states (NH) gift certificate laws concerning expiration dates, I have not been able to figure out about what additional terms/conditions are legit in NH? Specifically if you can legally state that a Gift Certificate can be non-transferable?

I was given a certificate by a friend to a local spa that she was originally given (she would never use it and she was not the original purchaser). The cert states that it cannot be transferred - so technically I can't use it (her name is on the original cert)?? I am a bit bummed about this, as I would really like to book the session.

I would love to hear if anyone else out there has information they can point me too about what terms and conditions are legit? Again, I am familiar with the escheat laws of NH, but am stumped on this one :\

If you pay cash, how do they know you aren't the person on the GC? Maybe that's slimy, I don;t know. I want my GCs to be used. No expiration, and totally transferable.

Thanks for the replies! I didn't want to call and ask and get a 'no', cause then it would be harder to try to use it I could always go under a different ID (yeah, a little slimy, but hey its a $150 GC and it pains me to think that it might not get used!!)

I'm the same way with my GC's - i WANT them to get used and my terms are that they are transferable - just have to present the cert at time of service.
